AUTONOMÍA DE LAS IGLESIAS Y SINDICATOS DE MINISTROS DE CULTO (PAPEL + E-BOOK)

En el año 2008, grupo de sacerdotes y laicos de la Iglesia Ortodoxa de Rumanía, quiso constituir un sindicato, pero ésta se opuso, alegando que con ello se lesionaba su autonomía. Las autoridades rumanas no permitieron entonces que el sindicato se constituyese, denegando su inscripción en el correspondiente registro estatal. Los promotores acudieron al Tribunal Europeo de Derechos Humanos, alegando que la denegación de inscripción suponía una violación del artículo 11 del CEDH. El presente libro estudia las dos sentencias dictadas por el Tribunal Europeo de Derechos Humanos en esta controversia, que se denominó caso Sindicatul “P?storul cel Bun” c. Rumanía. Un caso novedoso y complejo en el que confluyeron -incluso podría decirse que, bajo ciertos aspectos, más bien colisionaron- tres grandes cuestiones de fondo: el alcance de la autonomía de los grupos religiosos; la justa composición de los conflictos de trabajo en el seno de esos grupos; y los problemas derivados del reconocimiento y protección de la libertad sindical en ese mismo ámbito.
